When a Tenant Stops Paying: Florida Eviction for Remote Owners

Uncontested non-payment runs three to six weeks in Florida. The risk is not the timeline but the procedure: a defective three-day notice restarts everything.

An uncontested non-payment eviction in Florida commonly runs three to six weeks from notice to lockout — fast by US standards. The risk for a remote owner is not the timeline. It is that the process is unforgiving on procedure: serving the notice one day early can get the case dismissed, and the clock restarts.

It starts with a three-day notice, counted a specific way

Non-payment begins with a written three-day notice to pay or vacate. Under Florida statute section 83.56, those three days exclude Saturdays, Sundays and legal holidays — so a notice served on a Thursday before a holiday weekend does not expire on Sunday.

This is where owners lose cases. Filing the eviction action before the notice has properly expired can result in dismissal, and the landlord starts again from the beginning while the tenant remains in possession and still is not paying.

The practical point

The three-day notice is not a warning letter. It is a statutory prerequisite, and its defects are the most common reason a Florida eviction fails. This is not a document to draft from a template found online.

What happens after the notice expires

If the tenant neither pays nor vacates, the landlord files a complaint for eviction with the Clerk of the Circuit Court, attaching a copy of the notice, and requests that a summons be issued and served.

The tenant then has five business days after service to file a response. Where rent is disputed, the tenant is generally required to deposit the disputed amount into the court registry — a provision that tends to resolve weak defences quickly, because a tenant who cannot deposit cannot contest on that basis.

If the court issues a writ of possession, the tenant has 24 hours after it is posted to leave before the sheriff returns to remove them.

Realistic timelines

Published estimates cluster, with the usual caveat that they come from property management and legal marketing sources rather than court statistics.

Uncontested non-payment: commonly cited at around three weeks from a clean notice to lock change, with one guide giving a broader 21 to 45 days from notice to writ.

Contested: commonly four to eight weeks or longer, depending on the defence raised and the county's docket.

Compared with jurisdictions where a non-payment eviction can run many months, this is quick. It is a genuine structural advantage of the Florida market and one of the reasons it attracts rental investment.

What this means if you own from abroad

You are not going to run this process yourself from another country, and you should not try. Notices must be served correctly, filings made in the right county, and hearings attended. A remote owner needs either a property manager with an established eviction process or a Florida attorney on retainer — ideally both, with the division of responsibility agreed before a tenant is ever placed.

Ask a prospective manager two questions: who serves the notice, and who appears in court. If the answer to either is vague, that is the answer.

What we could not verify

None of the sources consulted address whether a non-resident owner faces additional requirements — for example a registered agent for service of process, or a local address for notices. That question is real and we could not answer it from public guidance. Put it to a Florida attorney before your first tenancy, not during your first dispute.

How to price it into the underwriting

Budget for it rather than hoping. A vacancy allowance should contemplate a turnover that includes a legal process, not only a clean move-out. Legal costs for an uncontested eviction are modest relative to the lost rent; the larger figure is usually the months that follow a bad tenant placement.

Which points at the real control: tenant screening. An eviction process that works is a safety net. It is not a substitute for not needing it.
